These Terms of Service ("Terms") govern your use of fila-mart.com and any orders you place for local pickup with JakeMakes LLC, doing business as Fila-Mart ("Fila-Mart", "we", "us", or "our"). By using our website or placing an order, you agree to these Terms. If you do not agree, please do not use the Services.

Eligibility

You must be able to form a legally binding contract to use the Services. The Services are intended for users who are at least the age of majority in their state of residence. By using the Services, you represent that you meet this requirement.

Accounts

You may need an account to use some features. You are responsible for the activity that happens under your account and for keeping your sign-in credentials secure. Please notify us promptly if you believe your account has been used without your permission.

Orders, Holds, and Pickup

Fila-Mart is a local pickup business. When you place an order, you are reserving items to be picked up in person. We hold reserved items for a limited window described at checkout. If an order is not picked up within its hold window, the reservation may be cancelled and the items returned to stock.

All prices, product descriptions, and availability are subject to change without notice. We reserve the right to limit quantities, correct errors, refuse or cancel any order, and decline service at our discretion, including when an item is mispriced, out of stock, or when we suspect fraud.

Payment

We do not collect payment through this website. Payment is made in person at pickup by Venmo or cash. Title and risk of loss for products pass to you at the time of pickup.

Rewards Program

We may offer a rewards or points program. Any points, rewards, or related benefits are provided at our discretion, have no cash value, and may be changed or discontinued at any time. Purchases paid for with store credit do not earn points. Additional rewards program details may be posted on our website.

Returns and Refunds

Returns, exchanges, and refunds are governed by our Refund, Return & Exchange Policy, which is incorporated into these Terms by reference.

Acceptable Use

You agree not to misuse the Services, including by attempting to interfere with their normal operation, accessing them through unauthorized means, using them for any unlawful purpose, or infringing the rights of others.

Intellectual Property

The Services, including our name, logo, text, graphics, and other content, are owned by or licensed to Fila-Mart and are protected by applicable laws. You may not copy, reproduce, or use our content without our permission, except as allowed by these Terms or by law. Product names and brands referenced on the site are the property of their respective owners.

Disclaimers

The Services and products are provided on an "as is" and "as available" basis. To the fullest extent permitted by law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Services will be uninterrupted or error-free.

Limitation of Liability

To the fullest extent permitted by law, Fila-Mart will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, arising from your use of the Services or products. Our total liability for any claim relating to the Services or a product will not exceed the amount you paid for the product giving rise to the claim.

Governing Law

These Terms are governed by the laws of the State of Wisconsin, without regard to its conflict of laws rules. Any dispute relating to these Terms or the Services will be subject to the exclusive jurisdiction of the state and federal courts located in Wisconsin.

Changes to These Terms

We may update these Terms from time to time. When we do, we will post the revised Terms on this page and update the "Last updated" date above. Your continued use of the Services after changes take effect means you accept the revised Terms.
